Article 0 — Constitutional Status of the Preamble

1. Normative value

The Preamble to the Be50 Charter is an integral part of the Be50 constitutional framework.
As such, it has legal and interpretative value superior to any other document, rule, procedure, or technical implementation of the Be50 project.

2. Interpretive role

Any provision:
  • of the Charter,
  • of the White Paper,
  • normative appendices,
  • operational rules,
  • or any future developments in the Be50 project,
must be interpreted in light of the Preamble. In case of doubt, silence, ambiguity, or conflict of interpretation, the spirit expressed in the Preamble prevails over the letter.

3. Intangibility

The Preamble is intangible.
It cannot:

  • be modified,
  • be deleted,
  • be replaced,
  • be circumvented by indirect rewriting,

regardless of:

  • the current mode of governance,
  • technological developments,
  • the number or identity of stakeholders,
  • the applicable jurisdiction at a given time.

Article 0 bis — Hierarchy of texts Be50

The normative order of the Be50 project texts is established as follows:
1. Be50 Preamble
2. Be50 Charter
3. Be50 White Paper
4. Normative appendices (including the internal circulation index grid)
5. Operational rules, interfaces, and technical implementations

No lower-level text may:
  • contradict,
  • weaken,
  • divert,
  • or neutralize a higher-level text.

Article 0b — Legal independence of the Preamble

The Be50 Preamble:

  • is not dependent on a specific technology,
  • is not dependent on a state,
  • is not subject to any particular legal form.

If the Be50 project were to:

  • change technological platform,
  • migrate to another infrastructure,
  • be taken over or rebuilt by a future community,

the Preamble would remain the key to the legitimate continuity of the project.

Article 0 quater — Internal enforceability

All members of the Be50 network:
  • founder,
  • developer,
  • partner,
  • merchant,
  • user,

acknowledges, by the mere fact of participating in the network, the enforceable nature of the Preamble in the interpretation of the project rules.
